The new intestacy laws introduce the terms "domestic partnership" and "multiple spouses and a spouse means not only a married person, but a domestic partner. A domestic partner may be someone of the same or opposite sex. Under the new intestacy laws a person may be in a relationship with a married person and one or more domestic partners all at the same time. The new rules is the priority of the spouse- if a person dies leaving a spouse or spouses as well as children of the one or more spouses then the spouse/s inherit the whole intestate estate and their children do not receive any benefit.However, if a person dies without a without a will leaving children from another relationship other than with the current spouse the estate is divided between the current spouse and the children from the previous relationships and children of the current spouse if any.There are new definitions of brother and sister no longer makes a distinction between whole and half blood. Whole and half blood siblings will be entitled on an equal footing under the new laws. First cousins will be entitled if no other relatives survive.
