Buying “Off the Plan”  is buying a promise that the space in the air which will be your unit one day will be all that has been promised to you.  Will you have what those glossy brochure say .  Recently I was involved with a client who bought a unit interstate. The contact gave the developer 7 years to finish the construction  and the contract  had no  details of many important matters such as details as to the flooring, kitchen appliance, lighting etc, etc .

Off the Plan gives the seller great flexibility on many aspects which is reasonable. I ensure this when acting for developers who face many uncertainties including those dictated by the local council. However buyers also need protection so that they are not forced to complete the purchase of something less than originally offered.

A solicitor with experience of the pitfalls needs to be on your side.
